Insurgent on the U.S. Capitol is Treason

How the insurrectionists’ behavior dictates long jail sentences.

Everyone who entered the U.S. Capitol on January 6 to circumvent the Electoral college certification is guilty of treason. Treason is a crime and should be treated as such. Insurrectionists who defaced the U.S. Capitol’s property, assaulted the Capitol police, and caused physical and mental harm, and even death need to have their day in court otherwise this scenario will repeat itself. If you do the crime, you got to do the time, no exceptions.

In the most recent court hearing for an armed Capitol rioter, Guy Wesley Reffitt, a Texas man, prosecutors are seeking a 15-year sentence as he was convicted of storming the U.S. Capitol with a holstered handgun due to his central role in the pro-Trump mob’s attack. He is known as a member of the Texas Three Percenters militia.

If Guy Wesley Reffitt’s fate is accepted by the judge as suggested by the Justice Department’s recommendation, his sentence will be three times the length of the other 200 insurgents who have been sentenced prior for crimes related to the January 6, 2021 insurrection against the U.S. Capitol.

Of course, as expected, Reffitt’s attorney is working to get his client off and sentence him to no more than two years in prison. Oftentimes, such a sentence ends up mostly engulfed by probation and little to no jail time. Again, a slap on the wrist creates a repeated environment because there is no real accountability when an insurgent walks away with little to no penalty.

While the defense attorney argues that his client did not assault the Capitol police or defaced the property, the prosecutor highlighted their justification for a longer sentence due to his planning strategy for weeks prior to January to travel to Washington with the intent to storm the Capitol and take over the Capitol and Congress.

Based on the evidence presented, it appears that not only did Reffitt intend to obstruct Congress’s certification of the Electoral College vote but intended to physically move the legislators from the U.S. Capitol using an arsenal in his possession, i.e. firearm, flexicuffs, with supportive assistance from the insurrectionist crowd to take over Congress.

Reffitt was the first Capitol insurrectionist to be tried in court and convicted by a jury in March on all five counts in his indictment; guilty of obstructing Congress’ joint session to certify the Electoral College vote, interfering with the Capitol police officers, and threatening his two teenage children if they reported his participation in the insurrection to law enforcement.

Also, Reffitt had an obvious role where he lit the fire that triggered the other insurrectionists to overwhelm the Capitol police officers near the Senate doors. A video captured Reffitt’s participation along with a mob of other insurrectionists who confronted Capitol police officers as they approached them on the west side of the Capitol.

The fact that Reffitt was armed with a Smith & Wesson pistol, carried zip-tie handcuffs, wore body armor, and a helmet equipped with a video camera that captured them advancing on the Capitol police nails the nail in his guilty coffin justifying a longer sentence. He was forced to retreat after he was pepper-sprayed by an officer but he wave the other insurrectionists on as they breached the Capitol. Obviously, he was complicit.

Reffitt’s actions and being armed spoke of his intent and purpose. His intent was conveyed by the testimony of a man, Rocky Hardie, who made the trip to Washington with him. He testified that Reffitt belongs to the Texas Three Percenters militia group and they both were armed with handguns when they attended Donald Trump’s “Stop the Steal” rally prior to going to the Capitol. Hardie testified that Reffitt had planned to drag lawmakers out of the Capitol and replace them with the insurrectionists’ desired counterparts deemed by Trump who would follow the Constitution.

Reffitt’s 19-year-old son, Jackson shared how his father threatened him and his sister, after returning home from Washington. He told them reporting him would make them traitors and traitors get shot.

In conclusion, a 15-year sentence is barely enough time to alert not only Reffittt but other insurrectionists about the extent of damage done to the U.S. Capitol, Democracy, death on their hands, the physical and mental harm to the Capitol Police, and the election integrity process. When you do the crime, you must do the time. The evidence speaks for itself, case closed. Reffitt and the likes of him of the insurrection, all need to land behind bars sooner than later.
