Dark and Darker Has Been Removed From Steam Due to Legal Complications

The developers of Dark and Darker, Ironmace, received a cease and desist order.

While reviewing gaming news in my feed and chatting in gaming communities, I noticed that Dark and Darker, an upcoming fantasy extraction game, has been taken down from the Steam platform due to a cease and desist letter and DMCA claim filed by publisher Nexon.

This move appears to escalate the ongoing legal dispute between Nexon and Dark and Darker developer, Ironmace, surrounding the game’s development assets.

The removal of assets and material from Dark and Darker’s Steam page, followed by the shutdown of its co-op and PvP servers, and ultimately the removal of the game from Steam’s store, took place overnight from March 24th into the 25th.

This latest action by Nexon follows a recent search of Ironmace’s offices earlier this month, where the police seized materials related to the game project.

In response, Ironmace stated that “absolutely no stolen assets or code were used to make our game” and reassured players that “nothing was found.” However, the Japanese-Korean game publishing giant disagrees with this statement, and as yet, no legal details have been made public.

A representative for Nexon posted a statement on the Dark and Darker Discord server saying that they have been served with a cease and desist letter and DMCA takedown notice regarding Dark and Darker based on distorted claims.

They added that they are working with their legal team to resolve the issue best. Still, due to the sensitive legal nature of the situation, they must be cautious with their statements so as not to jeopardize their position.

They asked for the community’s understanding as they work towards getting the game back up on Steam as soon as possible.

This latest development is part of an ongoing legal dispute between Nexon and Ironmace and personal legal disputes between Nexon and Ironmace employees.

According to Nexon, Ironmace employees were formerly working on a project called P3, which was canceled in 2021. Nexon alleges that P3 resembles Dark and Darker, implying that Ironmace used stolen assets and code to create its game.

Dark and Darker is an extraction shooter that includes first-person dungeon crawling elements, making it a unique game that has captured the attention of many gamers.

One reviewer noted that the game “proves extraction shooters don’t have to be shooters at all.”

The Open Alphas held over the last few months have been popular, with the game ranking among the top 100 most-played games on Steam during weekends when the alpha tests were available.

The next public playtest for Dark and Darker was scheduled to take place from April 14th to 19th, 2023.

The legal dispute between Nexon and Ironmace is not an isolated incident. In recent years, there has been a rise in legal battles over stolen assets and code in the gaming industry.

Ironmace has denied using any stolen assets or code, but Nexon appears to disagree. The legal dispute between the two companies may be resolved through negotiation, or it could end up in court.

It’s also unclear how the takedown of Dark and Darker will affect Ironmace as a company.

The loss of revenue from the game’s sales on Steam could be significant, and if the legal dispute continues for an extended period of time, it could have a negative impact on the company’s reputation.
