Race Norming Lacked Merit in the NFL

How “race norming” is not okay.

Systemic racism is so ingrained in the fabric of America’s soul, no profession or institution has gone unscathed. Another needed light has been shown on the sports field where racism has been running quietly from day one to the present time.

New rules in the NFL are bringing renewed hope to many retired football Black players who unlike their White counterparts were denied payments for dementia in the NFL’s 1-billion concussion settlements are now being allowed to be retested or have their claims rescored. The testing and payout formula were scored in the past with racial bias will now exclude racial bias under new rulings.

Without merit and/or even research data, with “race-norming” in the dementia testing, it was ASSUMED that Black players possessed the lower cognitive ability and it was deduced that it was difficult to gauge their mental declines linked to football. Since when is cognition predicated on race instead of autonomy?

Looking back over history in cases where Blacks were labeled inferior in many facets of life and profession, on the contrary, given the same playing field and access, history proved the opposites, that Blacks were just as capable and oftentimes more capable. Blacks have always been held to a higher standard of accomplishments unlike their White counterparts in their chosen profession.

The outrage of the Black players and their lawyers over the use of “race-norming” forced the NFL back to the negotiation table proving their claim lacked merit pertaining to Black players’ cognition.

This new ruling, “do unto all equally”, will afford many retired Black players to resubmit their claims which will add $100 million-plus to the NFL’s legal tab. There are some things in life that you cannot put a price tag on especially when people have given their all or life to their career.

Dementia is not only prevalent in society but the NFL has many players who have suffered trauma to their heads and bodies. Thus far, the NFL has paid out more than $800 million to date, mostly half for dementia claims. This fact alone confirms the reality of dementia or the possibility of dementia tied to the NFL sport due to concussion.

There are more than 3 million dementia cases a year in the United States. There are tests available to determine dementia and/or cognition. Dementia affects thinking and social symptoms that interfere with daily functioning. It affects man’s functions, memory loss, and judgment.

There are visible signs that are a result of dementia, forgetfulness, limited social skills, and thinking abilities impaired beyond the normal capacity of the individual.

There are some medications and therapies that can help manage or slow dementia progress as there are various stages and types of dementia. Some causes are reversible.

There are five stages of dementia, Stage 1: No Impairment, Stage 2: Questionable Impairment, Stage 3: Mild Impairment, 4: Moderate Impairment, Stage 5: Severe Impairment and there are seven types of dementia: Alzheimer's disease, vascular dementia, Lewy body dementia, Frontotemporal dementia, and mixed dementia. Note, there are myriad of causes for dementia, and thereby making a cure a reality is complex.

In conclusion, there has been much light shed on dementia in the NFL where some players have committed suicide and others’ mental capacity has succumbed and others are functioning. Kudos, to the NFL for doing the right thing by all its players.

The 2015 movie, ”Concussion,” starring Will Smith, depicted how the NFL tried to silence Dr. Bennett Omalu, a forensic pathologist as he fought against the NFL who tried to suppress his research on chronic traumatic encephalopathy (CTE) brain degeneration suffered by professional football players. To date, the rest is history and reality and the NFL must concede to this reality.
