Will “Strawberry Shortcake” Be The Reason Scott Peterson Is Granted A New Trial?

Could allegations of juror misconduct grant Scott Peterson a new trial?

Photo by Tingey Injury Law Firm on Unsplash

I was minding my business on Twitter, linking my Twitter accounts together.

Not bothering a soul. Then much to my horror, my eyes laser focused in on the trending column and that’s when I saw it. #ScottPeterson

You know him. I know you do.

Peterson is incarcerated at San Quentin for murdering his wife, Laci, who was 8 months pregnant with their first child, son Conner. However, that verdict was overturned by The California Supreme Court in August 2020 and ordered that he be re-sentenced to life in prison.³ The reason was that jurors who were not in favor of the death penalty were excluded unfairly.

I watched every bit of television coverage, including the trial, and yes, all the Nancy Grace episodes of the Peterson case.

I was there for it. All in.

I remember his arrogance as though it was yesterday. You know, I really wish he would own his shit, and allow her and Conner to rest in peace, at the same time providing peace for her loved ones.

But that’s not happening.

Nope. No. Notta.

And wouldn’t you know?

{pausing for a moment to collect myself}

There is a possibility that his verdict could be over-turned and a new trial granted.

The horror.

Scott was back in court with his legal team as closing arguments were heard. What are they alleging?

Peterson’s new legal team is alleging juror misconduct.

Peterson’s legal team is trying to secure the retrial by focusing on juror no. 7, Richelle Nice’s participation in his conviction.³ They said that she failed to reveal important information about her history as a domestic abuse survivor during the jury selection process.³

In the jury questionnaire, jurors were to disclose if they had ever been a crime victim or a subject of a lawsuit. Peterson’s lawyers are alleging she omitted the truth to get on the jury, claiming two separate reports made by Nice.

Nice, under oath at the hearing, stated she was never a victim of domestic violence and that she was actually the aggressor.

The second one stated Richelle filed a restraining order against her boyfriend’s ex-girlfriend claiming she threatened her when she was pregnant. According to Oxygen, Nice stated she made the report out of vengeance and was never in fear for her life.

Judge Anne-Christine Massullo will decide if juror misconduct occurred and if it prevented Peterson from receiving a fair trial.⁴

You can read a complete breakdown of Nice’s testimony written by Brian Melley at KCRA3 here

Lysee Mitri @lyseemitri, KCRA news reporter was tweeting from the courthouse.

Richelle Nice, nicknamed Strawberry Shortcake by the media, has been a controversial juror from the beginning, with some stating she wanted the limelight.

She received further criticism and more questions on the stand after they revealed that she sent mail to Peterson after his conviction. Under oath, Nice testified that she did send him mail, and her response to the court was that she just wanted to know why he killed his wife and unborn child.

Get in line sister.

See the prosecutor making his argument regarding Nice’s answers on the jury questionnaire tweeted by Law&Crime Network.

The Judge is expected to make a decision any day.⁴

My takeaway:

I giggled a bit when the prosecutor advised Peterson attorneys that when they considered removing Nice from the jury, Mark Geragos stopped that from happening, leading anyone with eyes and ears to believe he wanted Ms. Nice to serve on the jury.

They are grasping at straws at anything they can do to possibly get him a new trial.

Times up.

You lost. Again. Scott, you murdered your wife and your unborn child. So much grace has been given to you already. You are still alive.

I think he really believes that he's going to be free one day.

My honest opinion: Peterson's plea of innocence is a charade that he will continue to play as long as his mother is still alive. After she passes, headlines about Peterson will start to dwindle.

Do you think Scott Peterson is guilty or innocent?

How do you feel about the allegations against Richelle Nice; juror misconduct or defense attorneys stretching?

Do you think Peterson deserves a new trial?

I’d love to hear your thoughts. It’s okay if you disagree — we are all adults here.
