When All Else Fail, Time to Bring In The FBI

How a prosecutor justified officers shooting an unarmed Black man in the back of his head

Yesterday on the news, the prosecutor, Andrew Womble, of North Carolina justified multiple cops killing an unarmed Black man, Andrew Brown Jr, as he drove away, claimed he used his car as a weapon. In reality, he was probably running in fear of his life. Who has not seen all the killings of Black men and women, some killed while sleeping, others pulled over for air fragrance, or sleeping in a car and countless other unjustified acts of cruelty at the hands of law enforcement.

As the Pawquotank Country District Attorney, Womble, showed pictures from the police body camera footage during a press conference as he described his interpretation of the shooting, and when asked by the media about his interpretation that didn’t appear to align with his reality, the news reporters were dismissed. His dismissal spoke volume. What happened to confronting the truth or making it clear to others your viewpoint? Also, Womble said he would not release the bodycam video of the confrontation between Brown and the seven deputies on the scene during the shooting. Some even wore combat gear. Why?

It all started as they arrived to serve a search warrant and found Brown sitting in his car outside his home. They approached with their guns pulled out and yelling for him to surrender and got out of the car.

Brown proceeded to drive away, as a deputy standing close to the car had to remove himself and was not harmed. No doubt, Brown feared for his life. Of late, videos have brought to light so many people of color being mistreated, killed or wrongly accused. Sadly, to say, if Brown was white, this would have been a whole different scenario. Checkout the many YouTube and social media videos of police officers arresting a white person fighting with the cop, or taken the cops’ guns, cars or running them down, as the police never once pulled out his gun or shot the perpetrator. There is something wrong with this picture.

When it comes to people of color, often law enforcement tactics against people of color often end in death and is nothing new, just caught on cameras nowadays. Some law enforcement have gotten away with killing people of color for so long that it has become their norm, being protected by qualified immunity and no desertification.

Not only were these deputies action justified by the prosecutor, which sparked weeks of protest, these officers got to keep their jobs, will be disciplined and retrained. This was a slap in the face of the Brown’s family. This is unfortunate, an unarmed black man is dead fleeing an arrest warrant from seven deputies. These deputies get to go on with their lives. One time, a Black NY officer stopped a fellow officer from beating a civilian and she was disciplined, eventually fired loosing her pension, but years later fought back and a judge overturned all this injustice.

Body camera footage videos don’t lie, but can be misinterpreted to justify an agenda. This video looked as though Brown was trying to get away, no surprised there. The Browns’ family like the news reporter questioned the reality of what Brown was attempting to do after an arrest warrant was being issued. The chosen presented 44 seconds footage was unclear to ascertain what was really happening on that night, April 21, therefore the full video has been requested but the prosecutor thus far refused to release it. If these deputies actions were justified, releasing the video would exonerate them. Aiding and abetting is just as bad as the act of murder for its perpetuate an atmosphere for this to continue to happen and be justified by law enforcement. This 44 second footages gave news reporters lots of question but were dismissed by the prosecutor during the news conference.

This 44 seconds footage showed a chaotic scene of multiple angles as deputies approached Brown’s car with their guns drawn, while one deputy put his hand on Brown’s side door, yelling and backing away as Brown backed up. During this confrontation, the same deputy appeared to be in the direction that Brown was driving as the deputy moved aside, then gunshots rang out even as the car drove away.

According to the Womble, the deputy was jerked around over the hood of Brown’s car, his body was struck by his car, but he was unharmed. At this moment was when another deputy fired and this begun a round a bullets being shot all over the place, even in a nearby home. According to Womble at the news conference, Brown’s car posed a threat to the safety of the officers as he drove away, whether he was driving forward, backward or sideways, it didn’t matter, they were justified.

Womble justified the deputies action by saying, “I find that the facts of this case clearly illustrate the officers who used deadly force on Andrew Brown Jr. did so reasonably and only when a violent felon used a deadly weapon to put their lives in danger, and Brown posed an immediate threat to the safety of the officers and others.”

The Elizabeth City community and the rationale of people everywhere stated, “Not only was the car moving away from officers, but four of them did not fire their weapons — clearly they did not feel that their lives were endangered. And the bottom line is that Andrew was killed by a shot to the back of the head.”

Insiders take care of insiders, the prosecutor goal is to protect the deputies at all cost, the reason he refused to release copies of the videocam footage. This investigation deserves an outsider to look at the facts and all the video cam footage.

The FBI is pursuing a separate investigation. The North Carolina Gov. Roy Cooper, a Democrat, urged federal officials to perform a complete an unbiased and thorough investigation. There was a call for an independent investigator or a special prosecutor but Womble dismissed the idea. This matter needs its day in the court and they will decide what was reasonable or unreasonable. Also, the State Bureau of Investigation investigated but their findings were not released and has no plans to release their findings.

The three deputies who fired shots, Investigator Daniel Meads, Deputy Robert Morgan and Cpl. Aaron Lewellyn — have been on leave since it happened. The sheriff’s office said Morgan is Black, while Meads and Lewellyn are white. Four other deputies involved in serving the warrants were reinstated after the sheriff said it was clear they didn’t fire shots.

In conclusion, one unarmed man was served a drug arrest warrant by seven deputies, three of whom who fired nine shots at Brown, hitting him in the head, shoulder, arm, leg and back as he drove his car away. Clearly, this murder was preventable, and it did not appear that the officers’ lives were in danger based on the 44 seconds footage. Stay tune for the full release of the video.
