This weekend’s Transgender Day Of Visibility festivities arrive amidst a concerning trend of eroding rights for trans individuals across the United States.
In recent years, numerous states have enacted legislation that severely limits or outright prohibits gender-affirming healthcare for trans youth.
Need For Transgender Visibility
With only a minority of Americans reporting personal acquaintance with someone who is transgender, the overwhelming majority rely on media portrayals to form their perceptions.
This reliance is concerning because the media has a long history of distorting, mischaracterizing, and stereotyping transgender individuals. These inaccurate representations undeniably influence the public’s perception of transgender individuals, shaping misconceptions and setting detrimental standards for how individuals should interact with and treat transgender people.
It remains crucial for society to embrace authentic, diverse, and accurate narratives that reflect the real experiences of transgender individuals. Such narratives are essential not only for the understanding and validation of transgender individuals themselves but also for those who may have never encountered a transgender person.
This necessity extends to the realm of news media, where the voices of transgender individuals are often conspicuously absent in discussions about laws and policies that directly impact their lives.
Transgender Day of Visibility, observed annually on March 31, serves as a powerful reminder of the importance of representation and acceptance for transgender individuals. It’s a day to celebrate their courage, resilience, and contributions to society while also acknowledging the challenges they face.
I’m Glad That President Biden Supports Trans People
President Biden’s early action included signing an executive order titled “Preventing and Combating Discrimination based on Gender Identity or Sexual Orientation.” This directive emphasized the administration’s commitment to safeguarding LGBTQ+ rights, particularly for transgender individuals, against discrimination. It mandated federal agencies to enforce nondiscrimination policies, fostering inclusivity across diverse sectors.
The Human Rights Campaign praised Biden’s order as the “most comprehensive and impactful executive order addressing sexual orientation and gender identity ever issued by a U.S. president.” Extending Title IX protections to include gender identity affirmed transgender students’ rights to use facilities corresponding to their gender identity, fostering safer educational environments.
Additionally, President Biden reinstated the policy allowing transgender individuals to openly serve in the military and access gender-affirming medical care, signaling a return to inclusivity and equality within the armed forces.
The administration also prioritized healthcare protections for LGBTQ+ individuals, notably transgender individuals, by overturning discriminatory policies that permitted healthcare providers to deny services based on personal beliefs.
Nevertheless, numerous states are proposing laws that might override these federal mandates, particularly as it applies to people under the age of 18.
A New Multi-Media Campaign For Trans Youth
In anticipation of Transgender Day of Visibility, Lambda Legal, the nation’s premier legal nonprofit advocating for full equal rights for LGBTQ individuals and those living with HIV, has launched the dynamic multimedia campaign “Speak OUT: Trans and Nonbinary Voices.”
This groundbreaking initiative serves as a vital platform for transgender and nonbinary individuals to authentically share their narratives and lived experiences amidst today’s complex social and political landscape.
Percy Batista-Pedro (he/they), a transgender high school student and a key figure in Lambda Legal’s lawsuit challenging Iowa’s restrictive laws, encapsulates the campaign’s spirit: “I want people to see me as human, to understand that I’m just like them. If they took the time to talk with me, they’d realize we can laugh together, agree on some points, disagree on others, but ultimately, connect and have a meaningful exchange. Our existence is not new; we’ve always been here.”
Teen Vogue magazine published a statement from young transgender leaders involved in the new campaign, including Jazz Jennings, directed to other transgender youths.
They said that due to prejudice and discrimination, transgender people have to conceal who they are, even at the risk of being misrepresented.
Transgender people yearn for acceptance as their authentic selves. They simply wish to be welcomed and embraced for who they are and who they strive to become.
Every individual deserves visibility, love, pride, and the opportunity to flourish. All transgenders ask for is the freedom to be happy, to grow peacefully, and to live freely — a fundamental right for all humans.
The Fight Over Healthcare For Trans Youth
Many trans youth are now living in states in which transgender youth have lost access to, or are at risk of losing access to, gender-affirming care, because of discriminatory laws and policies.
As of November 2023, three in ten (35.1% or 105,200 total) trans youth aged 13–17 are living in states that have passed bans on gender-affirming care.
At the height of the legislative session, more than half (50.4%) of all trans youth were living in a state where a gender-affirming care ban had been introduced.
The following is just one example of the anti-trans actions being currently undertaken by states like Florida and Texas.
A Texas appeals court has upheld two injunctions blocking the state’s Department of Family and Protective Services from investigating families of transgender youth pursuing gender-affirming medical care. This legal battle stemmed from Governor Greg Abbott’s order in February 2022, directing investigations into parents providing such treatment, despite its endorsement by major medical organizations.
This directive coincided with Texas Attorney General Ken Paxton labeling these procedures as child abuse. Abbott instructed the department to swiftly investigate reported instances, resulting in at least nine investigations within two weeks.
Some of the youths involved believe that it is child abuse to deny their gender-affirming care.
Decisions About Trans Healthcare Should Be Made By Doctors, Not Politicians
Doctors and healthcare professionals undergo extensive training and education to master the intricacies of medical care, including transgender healthcare. Armed with the latest medical research, guidelines, and best practices, they deliver informed, evidence-based care to transgender patients.
