The Shariah Law Republicans Feared Is Here — And They Are Making It

You may recall Newt Gingrich and Bill O’Reilly vociferating about the dangers of Shariah law coming to the United States. Almost everyone with a brain wrote the two off as fools — except fifteen years later, they were right.

The Supreme Court is making Shariah Law.

Conservatism, in its extreme form, is always about codifying what other people can do. Shariah Law — the conservative aspect of Islamic law — limits the rights and freedom of women to control their minds, their bodies, and their worlds. US Law, as determined by the Supreme Court, limits the rights and freedom of women to control their minds, their bodies, and their worlds. Conservative Shariah Law condemns homosexuality, and it appears US Supreme Court is hell-bent on doing the same here. Conservative Shariah Law opposes birth control and contraception, and it appears that the Supreme Court is going to do that, too. Justice Thomas has called for it.

Welcome to the dark ages.

Conservatives, it turns out, are the same across religions. They seek to control others. They use religious reasoning to justify political power — precisely the problem the American founders were trying to avoid. You see, conservatism is not about a true set of principles, it is about the exercise of power. It is not about rationality and reason in search of solutions to real problems — it is about the exercise of power. Conservatism is about power — that’s all.

That’s also why it is so dangerous.

The conservative justices have for years decried judicial activism in an attempt to stymie liberal reasoning and discernment, yet now those same justices are undertaking the most breathtaking changes in the rights of Americans ever — all based on political and social ideologies. They are the judicial activists. There is no consideration — there is only the will to power and the will to exercise power against those who they wish to control.

So now, they are going to do that. If we ever were, the United States is no longer a shining city on the hill. We are a beacon for no one in any kind of freedom or liberty. We are about to become the most draconian, religiously driven, conservative society in the world, outside of Iran, Afghanistan, and possibly Israel.

This is what happens when a society allows its courts to become politicized. For most of our history, Supreme Court Justices were confirmed by extremely large majorities — often 90%+ of senators. Only recently have justices begun to be confirmed by party-line or near party-line votes. In fact, of the six justices voting to overturn Roe v Wade, five of them were approved with less than 55 senators voting for their confirmation. In a Senate generally divided close to the 50–50 line, the partisanship of those confirmations is obvious. The party-line vote is what has become so extremely caustic to jurisprudence.

It is also damaging the court.

The court is in a crisis of legitimacy. The national approval rating is now hanging around 25%. Clarence Thomas’ call to revisit other issues decided on an assumed right to privacy, like gay marriage and contraception, is an acknowledgment that conservatives have limited time and may not remail legitimate, so they better move fast. And they will move fast if they can.

Shariah Law is coming to the US — not despite conservatives, but because of them.
