Summary

A little-known federal judge in Florida, Kathryn Kimball Mizelle, appointed by Donald Trump, struck down the Biden administration's travel mask mandate, gaining national attention despite her "not qualified" rating from the American Bar Association due to her limited experience.

Abstract

US District Judge Kathryn Kimball Mizelle, a relatively young judge appointed by former President Trump, has recently come into the national spotlight for her ruling that blocked President Biden's mask mandate for travelers. Despite the American Bar Association rating her "not qualified" for a federal judgeship due to her scant post-law school experience, Mizelle's decision has significantly impacted the COVID-19 travel regulations in the United States. Before her appointment, Mizelle had an impressive resume, including clerkships with Supreme Court Justice Clarence Thomas and a role as a trial attorney in the Justice Department's Tax Division. Her ruling reflects the contentious debate over mask mandates, with some polls indicating that a majority of airline passengers support such measures for safety.

Opinions

  • The article suggests that it is surprising how much power a single federal judge, in this case Kathryn Kimball Mizelle, can wield in striking down a national mandate.
  • There is an implication that Mizelle's appointment and subsequent decisions are influenced by her connections to the Trump administration, as indicated by the comment "It is no surprise that she is a Trump person."
  • The American Bar Association's "not qualified" rating of Mizelle reflects an opinion that her limited experience post-law school was insufficient for the responsibilities of a federal judge.
  • There is a hint of public support for mask mandates, as some polls mentioned in the article suggest that most airline passengers feel safer with the mask requirement in place.

It is surprising how much power one person can have

The mask mandate for travelers on airplanes has been around for a while during the COVID pandemic. Since masks were found to be helpful in stopping the spread of COVID and in protecting people, they were required in many businesses and for travel.

Although the restrictions have now been lifted or reduced in many areas, masks can still be worn for safety. Some choose to wear them while others do not.

People became accustomed to wearing the masks on airplanes and in airports as well as on buses and other means of public transportation. Some airplane travelers objected vehemently to the masks and were removed from airplanes. Most people complied with the regulations and wore masks when requested to do so. Some people are in favor of masks while others fight against them.

There have been some reported polls that have indicated that most travelers on airplanes prefer having the mask mandate in place as it makes them feel safer.

The Biden Administration wanted the mask mandate to continue for travelers on airplanes and other public transportation for the time being. A federal judge in Florida blocked the mandate.

A story for CNN by Veronica Stracqualursi was titled: “Kathryn Kimball Mizelle: The federal judge in Florida who blocked Biden’s travel mask mandate.” She reported:

A little-known federal judge appointed by former President Donald Trump found herself in the national spotlight on Monday after striking down the Biden administration’s public transportation mask mandate.

US District Judge Kathryn Kimball Mizelle has been serving as a federal judge in Florida for more than a year. Notably, the Senate vote confirming her to the lifetime appointment came in mid-November 2020, after the presidential election. She had been given a “not qualified” rating by the American Bar Association, based on her limited amount of experience post-law school.

A young judge, Mizelle was born in 1987 in Florida. She received a law degree from the University of Florida Levin College of Law in 2012. She had four federal clerkships which included one with Supreme Court Justice Clarence Thomas from 2018 to 2019.

The CNN report states: She spent about three years as a trial attorney for the Justice Department’s Tax Division, where she prosecuted white-collar crimes, and before that was a special assistant US attorney for the Eastern District of Virginia for a year, she told the Senate Judiciary Committee.

According to the American Bar Association, the two cases she had tried to verdict were when she said she was a certified legal intern for Florida’s state attorney’s office and still in law school.

It is surprising that a federal judge in Florida who was basically unknown can have such power to rule against a mandate to wear masks on public transportation.

It is no surprise that she is a Trump person.
